Bush nominated Justice Roberts makes the key decision in Supreme Court ruling declaring Obama’s Affordable Car Act constitutional under the taxing power. It was deemed unconstitutional under commerce and necessary and proper clause, which is what Obama argued for all along. In fact, the administration and congress all along said no way was this a tax. More than that, the tax is distributed unevenly based on ones failure to follow a executive mandate they have no power to require. This makes it a fine, meaning the administration has no power to implement it! The 70% of Americans that oppose will not let this fly, 2010 elections all over again this fall. More to come.
